On March 31, 2021, New York made a historical move by legalizing adult-use cannabis by passing Marijuana Regulation and Taxation Act (MRTA)
Under MRTA, adults aged 21 or older can possess up to 85g of cannabis or 24g of concentrated cannabis. In addition, adults aged 21 and older can possess up to 5 lbs. of cannabis individually in their homes. Home cultivation of up to 3 mature and 3 immature cannabis plants per individual and up to 12 plants per household will be permitted once regulations for home growth are in place.
These are the following adult-use cannabis license types set out in MRTA:
- Cultivator, conditional cultivator, nursery, processor, conditional processor, distributor, cooperative, microbusiness, retail dispensary, conditional retail dispensary, on-site consumption, delivery, and registered organization
Cannabis Control Board (CCB) started by accepting applications for Adult-Use Conditional Cultivator, Adult-Use Conditional Processor, and Conditional Adult-Use Retail Dispensary (CAURD) Licenses. Please note that deadlines for some licenses may have already been passed.
