Adult Use Cannabis Legalization in New York

On March 31, 2021, New York made a historic move by legalizing adult-use cannabis through the Marijuana Regulation and Taxation Act (MRTA).

Under MRTA, adults aged 21 or older can possess up to 85g of cannabis or 24g of concentrated cannabis. Additionally, adults can keep up to 5 lbs of cannabis at home. Home cultivation of up to 3 mature and 3 immature cannabis plants per individual (and up to 12 plants per household) will be permitted once regulations for home growth are established.

The Cannabis Control Board (CCB) began accepting applications for Adult-Use Conditional Cultivator, Adult-Use Conditional Processor, and Conditional Adult-Use Retail Dispensary (CAURD) licences. Please note that application deadlines for some licence categories may have already passed.
